This Privacy Policy explains how Asideka Africa Company Limited (“Asideka”, “we”, “us” or “our”) collects, uses, shares and protects information in connection with the Asideka platform (the “Platform”). It applies to registered users, individuals and businesses whose information we compile as part of our directory, and visitors to our website. It should be read together with our Terms & Conditions.

1. Information We Collect

1.1 Information You Give Us

When you create a Solopreneur or Business account, claim a profile, or use the Platform, you may provide: your name and contact details; business name, registration details, location and description; products, services and category information; images and supporting documents; payment information, processed by our payment providers; and communications you send to us, including support requests and claim submissions.

1.2 Information We Compile About Businesses

As part of building our directory, Asideka researches and compiles information about businesses across Africa from publicly available sources, including company registries, business directories, websites and other public materials, before those businesses have created an account. This may include a business's name, location, category, contact details, products or services, and publicly available images. We treat this compiled information as belonging to the business it describes, and a business's owner or authorised representative can request to claim, correct, update or remove it at any time, as described in our Terms & Conditions.

1.3 Information from Your Use of the Platform

We collect information about how you use the Platform, including search queries, pages viewed, profiles interacted with, due diligence requests initiated, and device and log information such as IP address, browser type and access times.

2. How We Use Information

We use the information we hold to: operate, maintain and improve the Platform; create and display business profiles, including Asideka-sourced profiles pending a claim; verify identities, claims and business information; notify a business when it appears to have been listed, and support the claiming process; connect users to due diligence providers when requested and process related payments; provide AI-powered trade intelligence features; communicate with you about your account, transactions or support requests; detect and prevent fraud, abuse and violations of our Terms; and comply with legal obligations.

3. How We Share Information

We share information: with other Platform users, to the extent your profile or listing is public by design; with due diligence providers, only when you initiate a request to engage one, and limited to the information reasonably necessary for that engagement; with service providers who support our operations, such as hosting, payment processing, analytics and customer support, under confidentiality and data protection obligations; with regulators, law enforcement or other parties where required by law or to protect Asideka's rights, users or the public; and in connection with a merger, acquisition or sale of assets, subject to continued protection under this Policy or a successor policy.

We do not sell your personal information to third parties for their own marketing purposes.

4. Due Diligence Requests

When you request a due diligence engagement through the Platform, we share the information necessary for the DD Partner to understand and perform that engagement, which may include your identity and the identity and details of the counterparty you want assessed, where you have provided that as part of the request. The due diligence report and any personal or business information the DD Partner collects during its own engagement are handled under that DD Partner's own privacy practices, which we encourage you to review before proceeding.

5. Profiles Compiled Before an Account Is Created

If Asideka has compiled a profile of your business from public sources and you have not yet created an account or claimed it, you can request a copy of the information we hold about your business; ask us to correct inaccurate information; ask us to remove the profile, subject to our legitimate interest in maintaining an accurate business directory and any applicable legal requirements; or claim the profile to bring it under your own control.

Contact us using the details in Section 12 to make any of these requests.

6. Data Retention

We retain information for as long as your account or profile is active, and for a reasonable period afterward to comply with legal obligations, resolve disputes and enforce our agreements. Compiled business information for unclaimed profiles is retained for as long as the profile remains part of our directory, unless removal is requested and no legitimate ground for retention applies.

7. Data Security

We use administrative, technical and physical safeguards designed to protect information against unauthorised access, loss, misuse or alteration. No system is completely secure, and we cannot guarantee absolute security.

8. International Transfers

Because Asideka operates across multiple African countries and works with service providers who may be located elsewhere, information may be transferred to, stored and processed in countries other than the one in which you or your business are located. Where required, we take steps intended to ensure such transfers are subject to appropriate safeguards.

9. Your Rights

Depending on the laws that apply to you, you may have rights to access, correct, delete or restrict the use of your personal information, to object to certain processing, or to receive a copy of your information in a portable format. You can exercise many of these rights directly through your account settings, by claiming a profile, or by contacting us using the details below. We will respond to requests within the timeframe required by applicable law.

10. Children

The Platform is intended for business use and is not directed to children. We do not knowingly collect personal information from anyone under 18.

11. Changes to This Policy

We may update this Privacy Policy as the Platform evolves. Where changes are material, we will give reasonable notice before they take effect. Continuing to use the Platform after changes take effect means you accept the updated Policy.

12. Contact Us

If you have questions about this Privacy Policy, want to exercise a data right, or want to claim, correct or remove a profile compiled about your business, contact us at privacy@asideka.com.
